The personal data of users will be incorporated into a file duly reflected in the register of processing activities for which ubimia is responsible.

Accuracy and veracity of the data provided.
Users guarantee and are responsible, in any case, for the accuracy, validity and authenticity of the personal data provided, and undertake to keep them duly updated. When sending information with personal data, the user guarantees ubimia that he/she is the owner of the data or that he/she has the power of representation or that he/she has been granted consent by the owner of the data to provide them.

Purposes and Legal Basis of Processing
When browsing our website, we may collect personal information (“Personal Data” or “Data”) about you such as your IP address, first name, last name, telephone number or email address.

The Data may be obtained through various means, including but not limited to, the various forms that appear on this website or through cookies (in accordance with the provisions of the Section “Cookies Policy”).

Likewise, the user can register on the ubimia website, in which case he/she will be asked, via email or pre-established forms, for information such as his/her name, address, telephone number or email address.

In accordance with the applicable regulations, ubimia will process your data until such time as they become unnecessary for the purpose for which they are processed. Once these purposes end, ubimia will keep your data duly blocked for the periods shown in the table. The blocking of data means that ubimia may only process the data for the purpose of meeting any liabilities of any kind that may arise. Your personal data will be deleted when such liabilities expire.

Consent may be withdrawn at any time, but this will not affect any treatment that has already taken place.

Personal data provided on the Website that are considered sensitive categories of data, such as data that may reveal your physical condition, health, union membership, religion or beliefs, among others, will be processed by ubimia exclusively for the purposes for which the user had delivered them. Additionally, in the event that the user communicates to us, as representative and/or legal guardian of a data subject, his/her personal data for us to process them in accordance with the purposes indicated above, he/she expressly guarantees that he/she has sufficient legal standing to provide us with the personal data of said candidate.

When do we transfer the user’s personal information?
Only if the user expressly and previously consents, ubimia will transfer their personal data exclusively to the distributors of its products in the different areas of Spain or to other companies of the ubimia group dedicated to the same type of activity as ubimia. For this purpose, on the pages of this website where the data collection forms are located, the user will find a button entitled “Data Communication” by which you can authorize ubimia to transfer your data exclusively to the persons indicated.

If this option does not appear, ubimia will not transfer the data to third parties in any case, although it may allow access to third parties, processors, which is strictly necessary for the provision of a service to ubimia related to the service contracted by the user. To this end, ubimia ensures that all these entities comply with the applicable data protection regulations, which are also directly applicable to them, by regulating the commissioning of processing in accordance with the obligations indicated in Article 28 RGPD.

With respect to the whistleblower channel, the personal data processed in the investigation of the communication/complaint shall only be accessible by those pfs employees who perform the functions of internal control and compliance. However, we inform you that access by other persons, or even communication to third parties, will be lawful when necessary for the adoption of disciplinary measures or for the processing of legal proceedings, if any. For example, to judicial bodies, judges, prosecutors, State Security Forces and Corps or administrative authority to whom the result of the investigation is transferred, when so required by them or when the reported facts constitute a criminal offense.

Safety measures
ubimia will treat your personal data as absolutely confidential. It has also adopted the security levels of protection of Personal Data legally required by current legislation, and has implemented all the technical and organizational means and measures available to ensure the security of your personal data and prevent its destruction, loss, misuse, illegal access, unlawful alteration and theft of Personal Data provided by the user. When determining these measures, criteria such as the scope, context and purposes of the processing, the state of the art and the existing risks have been taken into account.

International data transfers
In principle, there are no international transfers of personal data. However, in the event that there is a possibility of personal data being transferred outside the European Economic Area, ubimia provides adequate data protection safeguards by ensuring that there is an adequacy decision from the European Commission for the relevant third country or by applying the Standard Contractual Clauses approved by the European Commission for international data transfers, as well as by ensuring that the recipient has similar security measures in place as those established by ubimia.

Rights of the interested parties
Rights of access, rectification, opposition, suppression, portability or limitation.

The user may exercise their rights of access, rectification, opposition, deletion, portability or limitation by sending a request with their name and surname. In the event that ubimia is unable to identify your identity correctly, it may request a copy of your ID card or document that allows verification of your identity in order to comply with the request to exercise your rights, to ubimia. The User declares to have been informed of the conditions on personal data protection, accepting and consenting to the automated processing of such data by ubimia, in the manner and for the purposes indicated in the informative clauses present in each of the sections in which personal data may be collected.

Information on data collection forms
ubimia provides Users with the appropriate technical resources so that, in advance, they can access this Privacy Policy notice or any other relevant information and give their consent for ubimia to proceed with the automated processing of their personal data. Except in the fields where otherwise indicated, the answers to questions about personal data are voluntary, and failure to answer does not imply a decrease in the quality or quantity of the corresponding services, unless otherwise indicated.

Acceptance of anonymous communications/complaints and responsible use of the Channel

Although anonymous communications/complaints are permitted, for greater efficiency in the investigation it is recommended that the informant be identified. If identified, the identity of the informant will be kept confidential, will be treated in strict confidence and will not be disclosed to the reported person or to third parties, except to the judicial authority, the Public Prosecutor’s Office or the competent administrative authority in the context of a criminal, disciplinary or sanctioning investigation.

ubimia trusts that any communication/complaint will always be formulated under the principles of honesty, truthfulness and good faith, so that whoever may maliciously make a false communication/complaint will be subject to the corresponding legal measures, including the imposition of disciplinary sanctions in the case of pfs employees.

Limitation of liability of pfstech
ubimia is not responsible for the veracity of the information that is not of its own elaboration and of which another source is indicated, so it does not assume any responsibility for hypothetical damages that may arise from the use of such information.

ubimia reserves the right to update, modify or delete the information contained in this website and may limit or deny access to such information.

ubimia is exonerated from liability for any loss or damage that the User may suffer as a result of errors, defects or omissions in the information provided by ubimia provided that it comes from sources outside ubimia.
